These terms and conditions outline the rules and regulations for the use of HealthAssure's Website, located at www.healthassure.in.
The Terms and Conditions contained herein shall apply to any person (“User”) using the services of HealthAssure Pvt. Ltd. and/or Kuzalin Services Pvt. Ltd. (“HealthAssure”) for making healthcare packages subscription payments through an online payment gateway service (“Service”).
A. Privacy Policy
HealthAssure respects the privacy of its users. Information is collected when the user voluntarily provides it through the website or during the course of using our services. Such information may be released when required to comply with legal process, investigate violations of these terms, protect the rights and safety of HealthAssure and its users, or investigate illegal activities. By using our services, you consent to the collection and use of information as described herein.
B. T&C for Product and Service Page
By accessing and using the HealthAssure product and service pages, users agree not to:
- Upload or transmit any information that belongs to another person without their consent
- Post, publish, or transmit any harmful, defamatory, obscene, or otherwise objectionable content
- Transmit any content that harms minors in any way
- Infringe upon the intellectual property or other proprietary rights of any party
- Violate any applicable local, state, national, or international law
- Transmit any misleading or false information
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity
- Transmit or upload software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware

HealthAssure works with corporates and insurers to deliver healthcare services through its network. The services offered include:
- GP Consultation
- Specialist Consultation
- Diagnostics
- Tele Services
- At Home Services
- Pharmacy
- Vaccinations
- Health Risk Assessment
The availability and scope of these services may vary based on the user's subscription plan and geographic location.
D. General Terms and Conditions For Online Payments
- Users must register or provide accurate information as required to complete transactions through the payment gateway.
- Users must comply with all applicable laws and regulations when using the online payment service.
- If any provision of these terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect (severability).
- These terms constitute the entire agreement between the User and HealthAssure regarding the Service and supersede all prior agreements and understandings.
- Electronic records of transactions maintained by HealthAssure and the payment gateway shall be binding and admissible as evidence.
- In case of a chargeback initiated by the user or the card-issuing bank, the refund shall be processed in accordance with the chargeback terms and the user's eligibility for such refund.
- A “chargeback” is defined as a demand by the card-issuing bank for the return of funds to the cardholder following a dispute or complaint regarding a transaction.
- HealthAssure and the payment gateway reserve the right to reject or cancel any transaction suspected of being fraudulent, and to take appropriate legal action.
- HealthAssure and the payment gateway shall not be liable for any delays, failures, or errors resulting from server slowdown, network congestion, or other technical issues beyond their reasonable control.
E. Limitation of Liability
- HealthAssure provides the Service on an “as is” and “as available” basis. No warranty, express or implied, is given regarding the Service.
- HealthAssure shall not be liable for any inaccuracy, delay, omission, or failure in the delivery of the Service or any information transmitted through the platform.
- To the maximum extent permitted by law, HealthAssure and its affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages, including loss of profits or monetary loss, arising from the use of the Service.
- The User agrees to indemnify and hold harmless HealthAssure, its officers, directors, employees, and agents from any claims, damages, or expenses arising from the User's use of the Service or violation of these terms.
- No employee, agent, or representative of HealthAssure shall be personally liable for any act or omission in connection with the provision of the Service.
F. Miscellaneous Conditions
- The failure of HealthAssure to enforce any right or provision of these terms shall not constitute a waiver of such right or provision.
- The User acknowledges that transmission of personal data over the internet may not be completely secure and accepts the associated risks.
- HealthAssure shall not be responsible for any loss arising from unauthorized use of the User's account or credentials.
- HealthAssure does not guarantee against theft, loss, or unauthorized access to the User's data or devices used to access the Service.
- The User is solely responsible for maintaining the confidentiality of their User ID and password and for all activities that occur under their account.
G. Debit/Credit Card, Bank Account Details
- The User must ensure that all debit/credit card details and bank account information provided for payment are correct, current, and belong to the User or an authorized person.
- By providing payment details and completing a transaction, the User authorizes HealthAssure and the payment gateway to process the payment in accordance with the transaction details. The User confirms that they have the right to use the payment instrument provided.
H. Personal Information
- HealthAssure may collect and process personal information as necessary to provide the Service and as permitted by applicable law.
- Personal information may be disclosed to third parties, including service providers and partners, to the extent necessary for fulfilling the Service and as required by law.
- By using the Service, the User consents to receiving communications via email and other channels for transactional, promotional, and service-related purposes.
- Any personal information previously collected by HealthAssure shall be managed in accordance with applicable data protection laws and HealthAssure's privacy practices.
I. Payment Gateway Disclaimer
The online payment gateway service is provided for the convenience of Users. HealthAssure and its payment partners do not guarantee the uninterrupted availability, security, or error-free operation of the payment gateway. Use of the payment gateway is at the User's own risk. HealthAssure shall not be liable for any loss, damage, or inconvenience arising from the use of the payment gateway or from any third-party service provider.
J. Governing Law and Dispute Resolution
These terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these terms or the Service shall be subject to the exclusive jurisdiction of the courts at Mumbai.
In the event of a dispute, the parties shall first attempt to resolve the matter through good-faith negotiation for a period of thirty (30) calendar days from the date the dispute is first raised. If the dispute is not resolved within such period, it shall be referred to arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996 of India. The arbitration shall be conducted in Mumbai, and the language of arbitration shall be English.
K. Grievance Redressal
For any complaints, queries, or grievances related to the Service or these terms, Users may contact HealthAssure's customer service at +91-022-61676600. HealthAssure endeavors to resolve all grievances within fifteen (15) calendar days from the date of receipt. If the grievance is not resolved to the User's satisfaction, it may be escalated to support@healthassure.in for further assistance.
